Common Sense Approach
Beginning with the initial consultation, your attorney should be working with you to develop an action plan designed to accomplish your goals and eliminate to the greatest extent possible unnecessarily expensive and wasteful or time consuming tasks. This involves:
- Understanding your circumstances and goals
- Thorough case analysis and development of a case strategy
- Realistic advice and guidance
- Consistent communication and transparency during all stages of your case
Most cases settle either through an informal negotiation between the parties or a formal mediation process with the help of a neutral third party. Settlement is not only less expensive and stressful than having a trial, it also allows you and your spouse or co-parent to develop creative “outside the box” solutions that you would not be able to achieve in a trial by judge or jury. While your attorney should make all reasonable efforts to resolve your case without going to trial, not all cases can or should settle; your attorney should be able to know how to effectively negotiate your case outside of Court and zealously advocate your interests at trial.
